Terms and conditions

PLEASE READ THE FOLLOWING INFORMATION CAREFULLY. BETÜL MALİK, ("WE") AND YOU HAVE ENTERED INTO A LEGAL AGREEMENT BASED ON THESE TERMS AND CONDITIONS (THE "AGREEMENT") AND YOUR ORDER CONFIRMATION. YOU AGREE TO BE BOUND BY THIS AGREEMENT BY PLACING YOUR ORDER WITH US. THE TERM "PRODUCT" MEANS THE ITEMS DESCRIBED IN YOUR ORDER CONFIRMATION FOR THE PURPOSES OF THIS AGREEMENT.

Order Acceptance and Cancellation

You acknowledge that your order represents an offer to purchase the Product under the terms of this Agreement. We must accept all orders, but we are not obligated to sell Product to you until we have done so. Even after sending you a confirmation email, we may choose not to accept orders at our discretion.

Prices

All prices, discounts, and promotions advertised on our website – www.betulmalik.com – or otherwise communicated on our social media accounts or elsewhere are subject to change at any time without notice. The price you will be paid for the Product will be the price in effect at the time you place your order, as stated in your Sales Order. Only orders placed after the price adjustments will be affected.Taxes and charges for shipping and handling, as well as value-added taxes, custom fees, and other similar charges assessed in foreign countries ("International Charges"), are not included in the posted prices and are your responsibility. Shipping and handling charges, as well as International Charges (if any), are reimbursements for the costs we incur in processing, handling, packing, shipping, and delivering the Product. All applicable taxes and fees will be added to the final price of the Product and detailed on your Sales Order. We make every effort to show accurate pricing information; but, inadvertent typographical errors, inaccuracies, or omissions related to pricing and availability may occur. We retain the right to correct any mistakes, inaccuracies, or occurrences  at any time and to cancel any orders placed as a result of such errors, inaccuracies, or occurrences..

Shipment

We currently only ship in the United States. We will make arrangements for the Product to be delivered to you. Some products are not in stock . Those (not in stock) items will take 2 weeks to ship. All shipping and handling charges, as well as international charges (if applicable), will be paid by you. When we transfer the Products to the carrier for delivery, title to the Products passes to you. Upon delivery, the risk of loss transfers to you. We will insure all shipments of the Products against loss or damage while in transit. You must open all packages as soon as possible after receiving the Product to ensure that it is unharmed. You must file a claim with us within twenty-four (24) hours of the delivery date if the Product is damaged. Please contact info@betulmalik to file a claim. Dates for shipping and arrival are simply estimates and cannot be confirmed. We are not responsible for any shipping delays.

 

Force Majeure

We will not be liable or responsible to you, nor will we be deemed to have defaulted or breached this Agreement, if and to the extent that such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, flood, fire, civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes earthquake, explosion, riot, governmental actions, war, invasion, or hostilities (whether declared or not), terrorist thralls  or power outage.

Final Agreement

The Agreement outlines your entire agreement with BETÜL MALİK about the sale, purchase, and use of the items. They supersede any prior agreement or understanding relating to the subject matter of this document. We are not bound by any variation of this Agreement unless we have agreed to it in writing.

Attorney’s Fees

Regardless of whether litigation, arbitration, or another dispute resolution process was initiated, if we prevail in any disagreement with you related to this Agreement, you agree to pay us our reasonable attorneys' fees and costs associated with the issue.

Governing Law

Regardless of where the transaction occurred, the Agreement shall be construed and enforced in accordance with and controlled by the laws of the State of CALIFORNIA, action, suit, or proceeding brought to enforce any provision of this CALIFORNIA.

No Exceptions

Failure by us to enforce any right or provision of this Agreement does not imply that we will not enforce that right or provision in the future. Any waiver of a right or provision will only be valid if it is in writing and signed by a duly authorized representative of our company.
